Whether you are in Australia or overseas at JSM Lawyers & Notaries we provide notary services. In addition to Australian public notary services, we also offer apostille and authentication services where required.

 

What is a Notary Public in NSW?

 

A Notary Public and Public Notary are various descriptions of the same profession. In NSW, a Notary Public is a practising solicitor, who is appointed for life by the Supreme Court of NSW and given statutory powers to witness documents, administer oaths, and perform other wide-ranging and useful administrative functions of a national and international nature.

 

A Justice of the Peace (JP) in Australia provide services similar to American notaries, but American notaries are not qualified to witness documents for use in foreign countries as Australian notaries are. Australian notaries have this exclusive right and are the only true international "JP's" practising in Australia.

All Notaries' seals and signatures are officially recorded in a data base held the Department of Foreign Affairs and Trade (DFAT), a government department authorised to issue Apostille or Authentication Certificates authenticating the signatures, seals, or stamps of Notaries on Australian public documents.

What Notary Public services do we provide?

We provide a broad range of notarial services.  We have not listed them all, but some of the most common ones are:

  • Authenticating official, Government and personal documents and information for use overseas

  • Witnessing signatures of individuals to documents and authenticating identity

  • Witnessing Powers of Attorney, wills, deeds, contracts and other legal documents for use overseas, including from time to time, preparing them

  • Certifying true copies of documents for use overseas

  • Verifies documents for use in overseas countries

  • Administer oaths for international documents

  • For corporations and business, witnessing documents and authenticating status and transactions

  • Dealing with documentation for land, property and deceased estates overseas

  • Attests documents and certifies their execution for use in overseas countries

 

Apostille, Authentication and Legalising Service

 

JSM Lawyers & Notaries is able to provide to clients, for an additional fee, an Apostille, Authentication and/or Legalising Service, including obtaining Apostille(s), Authentications from DFAT and arranging legalising of documents from the relevant embassy or consulate.

 

What costs are charged for Notary Public Services?

 

Usually JSM Lawyers & Notaries charges in accordance with the recommend scale of fees published by the NSW Notaries Society, but to obtain an accurate quote please contact our office via telephone or email.
